The issue № 9 of the international journal “Football Legal”
On 30 July was published the issue № 9 of the international journal “Football Legal”, dedicated to problems of football law, in which were published articles of the partners of the SILA International Lawyers Yury Zaytsev (“Legal Aspects of the 2018 FIFA World Cup Russia”) and Georgi Gradev (“Clubs cannot seek to profit from a situation whereby they attribute to a player’s services a greater value than they are willing to pay the player in return for those services” and “Sidelining a player for a month is not always just cause for termination of a contract in the eyes of FIFA”).
In his article Yury Zaytsev described which guarantees Russia provided to FIFA before the holding of the tournament and which changes the Russian legislation underwent in view of guarantees provided to FIFA. The article gives a brief review of the federal law, adopted in connection with the FIFA World Cup in Russia, № 108-FZ “On preparation and holding of the FIFA World Cup 2018, the FIFA Confederations Cup 2017 in the Russian Federation and amendments to certain legislative acts of the Russian Federation”.
In the article titled “Clubs cannot seek to profit from a situation whereby they attribute to a player’s services a greater value than they are willing to pay the player in return for those services” Georgi Gradev told about the findings of the FIFA Dispute Resolution Chamber and the Court of Arbitration for Sport in Lausanne on “Zinchenko’s case”, when FC “Shakhtar” clearly showed his lack of interest in the player’s actions, but when the player was transferred from FC “Ufa” to FC “Manchester City”, it filed a claim to the FIFA with a demand to oblige Zinchenko and FC “Ufa” to pay an unreasonably large amount of compensation.
In the article “Sidelining a player for a month is not always just cause for termination of a contract in the eyes of FIFA” Georgi Gradev analyzed the findings of the FIFA Dispute Resolution Chamber and the Court of Arbitration for Sport in Lausanne (CAS) on the case Atanas Kurdov against FC “Astana”. In this case, CAS upheld the appeal filed by the Bulgarian player, Atanas Kurdov, setting aside the FIFA decision on the dispute between the parties. The Sole Arbitrator, contrary to FIFA, decided that the player had just cause to terminate his contract after having been sidelined by the club for slightly over a month; having been put on the transfer list; and having been summoned to join the reserve team in the last minute with no apparent sporting or legal justification for undetermined period of time.
