The Moscow Arbitration Court dismissed the claim of the All-Russian Fitness and Sports Society (AFSS) “Dynamo” on the “M’Vila case”
The Moscow Arbitration Court did not satisfy the claim of the All-Russian Fitness and Sports Society (AFSS) “Dynamo” to acknowledge the amicable agreement between the Football Club Dynamo (Moscow) and a French football player Yann M’Vila invalid.
The first-instance court dismissed the claim of the AFSS “Dynamo”. “We consider this decision to be fair. We hope that the Russian Football Union will take it into account”, – commented Mikhail Prokopets, reminding that the money that FC Dynamo has to pay to M’Vila under the terms of the amicable agreement is on the RFU’s settlement account as collateral. AFSS “Dynamo” owns a controlling stake in the FC Dynamo Moscow. In January 2013 M’Vila signed a four-year contract with FC Rubin. Part of the season 2014/15 the midfielder was on a loan basis in the Italian FC Inter, and in the spring of 2015, as it was said in the media, FC Dynamo had reached an agreement on his transfer. M’Vila had been training with the first team of the white-and- blue from March to July 2015, and then he left the club. In the season 2015/16 he was loaned from FC Rubin to the English FC Sunderland. In June 2016 M’Vila and FC Dynamo entered into an amicable agreement, which the current Dynamo’s leadership considers illegal; the club had to pay the player compensation under the terms of the agreement by three tranches. The first two had been paid, then the Dynamo’s leadership was replaced, and M’Vila did not receive the third tranche, therefore he lodged a claim to the RFU Dispute Resolution Chamber – according to TASS, the player expects to receive € 360 thousand from the club. 18 October 2016 the chamber partially satisfied the player’s claim having obliged FC Dynamo to pay him the debt, as well as the penalty for delay in payment. The club appealed the decision before the Court of Arbitration for Sports, but it has never been considered.
M’Vila, extending the contract with FC Rubin in December 2016, again lodged a claim to
the RFU Dispute Resolution Chamber with a request to impose sanctions on FC Dynamo. As a
result, 14 July 2017 the club was banned from registering new players until fulfilling the
obligations towards M’Vila. However, in August this sanction was replaced with a deposit to the
RFU’s settlement account as a collateral of proper execution of the decision.
