CAS confirmed that actions of RFU, denying execution of its own decisions are illegal
On 6 July 2016 The Court of Arbitration for Sports (CAS) reached a decision on case of players agent Alexander Lopyrev against Russian Football Union (RFU) and Football Club “Krylya Sovetov”.
CAS established that decisions of RFU Dispute Resolution Chamber (NDRC) and RFU Players Status Committee (NPSC) are illegal and absolutely contrary to “tempus regit actum” principle and statutory provisions of RFU and its Regulations.
By its decision CAS changed the practice of jurisdictional bodies of RFU, that following long time after enacting the RFU Intermediary Regulations (30 March, 2015) denied on execution of NDRC and NPSC decisions on agents cases, reached before RFU Intermediary Regulations was adopted.
Considering the CAS Decision on “Lopyrev case” all the agents, who were illegally deprived their right on execution of RFU decisions by RFU jurisdictional bodies, can submit claims to NDRC on execution of such decisions.
By the way the CAS decided that 90% of costs of the proceedings in CAS following illegal actions of NDRC and NPSC shall be paid by RFU.
