CAS upheld appeal of players’ agent Danilyuk against RFU and FC Shinnik
Court of Arbitration for Sport (CAS) upheld an appeal submitted by players’ agent Mikhail Danilyuk against the decision of RFU Players’ Status Committee, and ordered FC Shinnik to pay to the agent his remuneration in accordance with representation contract. Last week a similar decision was rendered by CAS in case “Alexander Lopyrev v. RFU and FC Krylya Sovetov”.
Mr Danilyuk filed a claim to the RFU against FC Shinnik when Players’ Agents Regulations were still in force. However, RFU rejected agent’s claim because Players’ Agents Regulations was canceled at the date of dispute consideration.
CAS again has corrected RFU’s mistake, pointed out that the principle “tempus regit actum” should be applied. The sole arbitrator also confirmed that the dispute should be solved according to the regulations acted at the date of initial claim.
