MFC “Sinara” sanctioned with points deduction for failure to perform the decisions of jurisdictional bodies of RFU
On Thursday, April 10, 2014, Dispute resolution chamber of RFU (NDRC) passed the decision to sanction MFC “Sinara” with the deduction of three points for non-performance of the decisions of NDRC and Players Status Committee of Russian Football Union (PSC RFU).
By the NDRC and the PSC RFU decisions, passed in June and September 2012, mini-football club was bound over to pay the salary debt and the compensation for termination of the employment contract with S.L. Skorovich. Non-performance of the contract obligation by MFC “Sinara” to transfer the apartment to the coach, was adjudged as a liability to pay the cost of apartment. It stands to mention, that the case was brought to the highest sporting instance –to the Court of Arbitrations for Sport in Lausanne. But the claim was rejected by the CAS and the football club took out the process to the civil court of Russia, where the club also failed. In the issue of non-fulfilment of the NDRC and the PSC RFU decisions from 2012, MFC “Sinara” suffers not only financial loses constituting of default interest, but also as a result of S.L. Skorovich filing the claim of non-fulfilment of the above-mentioned decisions to the NDRC, three points in championship will be deducted from the football club. The interests of the coach in all instances are represented by the partner of Legal Company “Legal Sports” Mikhail Prokopets and by the lawyer of the company Darina Nikitina.
