The FIFA Dispute Resolution Chamber (DRC) has rendered a significant decision in favor of Al-Arabi SC (Kuwait) in an employment-related dispute against the player Hasan Hamdan Habib Al-Enezi (Kuwait)
The DRC upheld the club’s claim for compensation following the player’s breach of contract during the protected period.
In its reasoning, the Chamber awarded compensation calculated not only on the basis of the residual value of the contract but also incorporating replacement costs, confirming an increasingly robust approach to the assessment of damages under the FIFA Regulations on the Status and Transfer of Players.
In addition, the player was sanctioned with a restriction of four months on his eligibility to play in official matches.
SILA International Lawyers acted as counsel to Al-Arabi SC in these proceedings.
We thank Al-Arabi SC for its continuing trust in our services.
