The Higher Regional Court of Düsseldorf (Oberlandesgericht Düsseldorf) has rejected the FIFA’s appeal against the decision of the District Court of Dortmund regarding suspension of certain provisions of the FIFA Football Agent Regulations
This ruling is final. Accordingly, the provisions of the FIFA Football Agent Regulations currently remain suspended for the German market, meaning that they do not apply to transactions involving German persons and entities (clubs, agents and players/coaches).
The practical conclusion is that in the near future, FIFA will not cancel its Circular dated 30 December 2023, by means of which certain provisions of the FIFA Football Agent Regulations were suspended worldwide.
At the same time, the main dispute (not about suspension, but about inapplicability) of the FIFA Football Agent Regulations to the abovementioned transactions is still pending before the District Court of Dortmund.
The outcome of this dispute will to a large extent determine the fate of the FIFA Football Agent Regulations.
